ELMIRA TOWNSHIP COUNTY OF OTSEGO ELMIRA, MICHIGAN DECEMBER 11, 2003
A regular meeting of the Elmira Township board was held on December 11, 2003 at the Elmira Township hall commencing at 7:00 p.m. with Supervisor, Ralph Robarge calling the meeting to order with the Pledge of Allegiance.
Members in attendance were Supervisor, Ralph Robarge, Clerk, Susan Schaedig, Treasurer, Diane Purgiel and Trustees, Leonard Skop and Theresa Plachta. Others attending were Carl Essenmacher, Don Franckowiak, Al Bentz, Ron Geiger and Bob DeLong.
NEW BUSINESS: Bob DeLong of Dunn’s Business Solutions gave a presentation on three new copy machines and one used.
Leonard made a motion to purchase the used Ricoh 200 copy machine for $1,650.00 and a Full Service Maintenance Agreement at .021 cents a copy($42.00 a quarter) from Dunn’s Business Solutions. Seconded by Diane and carried unanimously.
The board decided to hold on to the assessor’s old laptop computer since the Fire Department is having trouble with theirs.
Ralph and Leonard reported on the Road Commission meeting they had attended. Mike Roper explained the T-21 funding procedures and that the name is being changed. He had a priority list of Primary Roads and mentioned that the projected dates are being pushed back a year or more due to lack of funds. OCRC used their future funds on West Otsego Lake Drive, on a new salt shed and a loader.
A committee of one member of each governmental unit in the county will meet at 9:00 a.m. on January 6, 2004 at the Road Commission office to develop a plan to place road millage on the ballot in 2004. Leonard will represent Elmira Township.
Everyone is encouraged to write our legislators to support SB 387 which would put the same road tax on diesel fuel as gasoline.
CenturyTel is filing a petition with the Michigan Public Service Commission to approve an adjacent exchange calling plan which will allow 546 customers to call Alba, Boyne Falls, Boyne City and East Jordan for a fee around $5.00. They would like the township to pass a resolution to support this petition. The board discussed the issue and decided not to support it.

Diane was given permission to send tax receipts to the taxpayers.
PLANNING COMMISSION REPORT: The next PC meeting will be held on January 27, 2004. The board discussed the 2004 proposed budget of $13, 085.00 and John Wiacek’s absences.
Diane made a motion to accept the proposed Planning Commission budget for 2004. Seconded by Leonard and carried.
Ralph stated that he has tried contacting John Wiacek by telephone several times and has never received an answer so the board reviewed the list of former applicants for the PC and will contact Jack Middleton and Paul Coon for interviews at the next township board meeting.
Theresa made a motion to inform John Wiacek by certified mail that he no longer is a member of the Elmira Township Planning Commission. Seconded by Leonard and carried unanimously.
ASSESSOR’S REPORT: No land divisions. Form 4408, Assessing Officer’s Report of Property Taxes Levied for Revenue Sharing completed and sent into the State Tax Commission Property Tax Division. December Board of Review went well. Five homestead corrections and three description corrections as Equalization did not pick up land transfers.
ORDINANCE OFFICER’S REPORT: Still working on junk vehicles from a year ago.
UNFINISHED BUSINESS: Ralph sent an e-mail to Michigan Townships Association with the copy of the 1994 legal opinion to reaffirm that public funds cannot be used on private roads. Ryan Dobrzelewski will be informed that Elmira Township cannot help him with Thompson Road improvement.

Diane made a motion to rescind her motion made in November to write a check for $3,942.50 to the Fire Authority and ask for reimbursement to the township in December when taxes are collected. Seconded by Leonard and carried unanimously.
Diane made a motion to write a check for $5.677.20 to the Fire Authority for the township’s share of the $7,200 grant.(check written for $3,942.50, another check for $1,734.70 will be written) Seconded by Theresa and carried unanimously.

Diane made a motion to pay the bills. Seconded by Theresa and carried.
Sue made a motion to pay for the registration, mileage, hotel rooms and per diem for the MTA Conference in January, 2004 for any board member. Seconded by Diane and carried.
Diane made a motion to allow $100.00 for meals for the 2004 MTA convention. Seconded by Theresa and carried.

ELMIRA TOWNSHIP COUNTY OF OTSEGO ELMIRA, MICHGIAN NOVEMBER 13, 2003 A regular meeting of the Elmira Township board was held on November 13, 2003 at the Elmira Township hall commencing at 7:00 p.m. with Supervisor, Ralph Robarge calling the meeting to order with the Pledge of Allegiance. All members present. Diane made a motion to accept the minutes as read. Seconded by Theresa and carried. TREASURER’S REPORT: CD 102,651.93 Gen Fund 22,382.82 Gen Fund CD 82,877.89 TOTAL 207,912.64 Diane reported that there will be an adjustment of $100.00 by Young, Graham & Elsenheimer, P.C. on the RFB Cellular matter. Diane had Dunn’s look at the copy machine at the township hall and has invited them to come to the meeting in December to present offers. Leonard made a motion to pay Otsego County Equalization Department 1.30 per parcel for the monthly maintenance fee of the tax roll and printing of tax bills for the next contract year and then a 3% increase over the next three years of a four year contract. Seconded by Diane and carried unanimously. PLANNING COMMISSION REPORT: Diane read the minutes of the October 28, 2003 meeting. John Wiacek has missed several meetings and this issue will be addressed. Next meeting on November 25, 2003 at 7:00 p.m.. No December meeting. The Otsego County Planning Commission is intending to amend the County Master Plan and is requesting cooperation and any comments to assist in this process. UNFINISHED BUSINESS: A copy of the Nuisance Ordinance was sent to Bryan Graham and he feels that the 1987 ordinance should be repealed. The estimated fees to enact a new nuisance ordinance and a dangerous structure ordinance are $500.00 Theresa made a motion to retain Bryan Graham to prepare a Nuisance Ordinance and a Dangerous Structure Ordinance and to prepare a repeal of the 1987 Nuisance Ordinance. Seconded by Sue and carried. Ralph received a 1994 opinion from the MTA legal staff in regard to the Thompson Road improvement which stated since it is private property no township funds may be spent. Leonard suggested that the township try to obtain a later opinion in regard to this matter. Issue tabled. Ralph made a motion to appoint the Elmira-Warner Fire Authority as collecting agent for the Fire Charges Ordinance. Seconded by Diane and carried. Ralph and Leonard checked the playground equipment and found no problem with loose boards. They suggested that the top be taken down. Matter tabled. NEW BUSINESS: Diane made a motion to write a check for $3,942.50 to the Fire Authority and ask for reimbursement to the township in December when taxes are collected. Seconded by Leonard and carried. The current taxable value for Elmira is $55,305,939(.7885);Warner’s Taxable Value is $14,835,516(.2115/$1,057.50). The board reviewed Verizon North’s application under the Metro Act for rights-of-way. Leonard made a motion to approve Verizon North Inc. application for access to and ongoing use of public ways by telecommunications providers under Metropolitan Extension Telecommunications Rights-Of-Way Oversight Act 2002 PA 48 MCLA Sections 484.3101 to 484.3120. Seconded by Diane and carried unanimously. Michigan Townships Association would like all townships to join them in an effort to stop revenue sharing cuts by sending a message to Lansing through our local media. A workshop will be conducted by Keskine, Cook, Miller, Smith & Alexander to aide the audit process on December 11, 2003 at the University Center from 10:00 to 2:00. Diane made a motion to pay the registration and half a days wages for Diane and Sue to attend the workshop given by the Learning Center on December 4, 3003. Seconded by Leonard and carried. A regular meeting of the Elmira Township board was held on October 9, 2003 at the Elmira Township hall commencing at 7:00 p.m. with Supervisor, Ralph Robarge calling the meeting to order with the Pledge of Allegiance.
Members in attendance were Supervisor, Ralph Robarge, Clerk, Susan Schaedig, Treasurer, Diane Purgiel and Trustees, Leonard Skop and Theresa Plachta. Others attending were Ryan and Bob Dobrzelewski, EMS Medical Service Director, Jon Deming and Assessor, Jill Kassuba.
Jon Deming asked the board to consider purchasing a generator for the township hall in order to use it in an emergency. At this time there are no grants. The board will consider the generator in the next budget year.
Ryan Dobrzelewski owns Block 16 in Elmira. There is a platted road(Thompson Rd) which was never developed into a road. He is asking the board to consider making this a road which would make it open for possible development. Tabled.

Diane moved funds over to Northwestern Bank. The township is covered up to 100,000.00 at First Nat’l so she left funds there. Diane also spoke to officials at First National who said that there were some bad loans made and that they are trying to collect them.
No Planning Commission meeting since there was not a quorum. Diane and Gloria were present and also advisor, John Ernst.
ASSESSOR’S REPORT: Jill working with Jim Theisen to fix the lap top computer so it is capable of backing up the records from 2000 – 2004 which are on the windows program. Awaiting the BSA program diskette to install in the new computer and current back ups to be made.
The County Treasurer has signed the Homestead audit form.
No Land Divisions.
Have not been advised by the State Tax commission on the Skibinski Case as to date. Received a MTT on Small Claims division of Michigan Electric Transmission Company vs. ElmiraTownship(obtaining information to respond to claim). Has not been advised on the Dale Smith cases.
Jill is requesting a phone card for long distance calling since she is removing the coverage on her home phone.
The Map training program was great. Jill picked up a set of training booklets for the office and to let her know if anyone would like one.
The L-4029 Form was completed and signed with the value of the loss taken from my assessment roll. Bill Kerr advised that I use a different number that he used in establishing the value in May for a State report. His number was established with a loss of the split parcels, IFT’s, class changes, etc. I have redone a revised copy for signatures.
Diane made a motion to allow Jill to purchase a phone card for township business. Seconded by Sue and carried unanimously.
Diane made a motion to accept the figures of the L-4029 as completed by Jill on 9-27-03. Seconded by Leonard and carried unanimously.
Ralph and Jim Theisen purchased a laptop with a zip drive from Circuit City for $1,309.90 with a rebate for $230.00. A case from Wal Mart, 18.88. Total Cost $1098.78.
The board discussed payment to Jim Theisen for assisting with the assessor’s computer.
UNFINISHED BUSINESS: Elmira Township has a shelter agreement with the Salvation Army to provide space in the event of an emergency. Ralph provided Ron Chavey with the Supervisor’s, Clerk’s and Treasurer’s telephone numbers.
The board addressed the Fire Charge Ordinance. It was agreed to 40 acres of property involving fires of extraordinary costs.
Leonard made a motion to adopt the Elmira Township Fire Charges Ordinance which establishes charges for certain fire protection services pursuant to Act 33 of the Public Act of 1951, as Amended (MCL 41.801 ET SEQ) to provide exemptions from those charges, and to provide methods for the collection of such charges. Seconded by Diane and carried unanimously. AYES: RALPH, SUSAN, DIANE, THERESA, LEONARD NAYES: NONE ABSENT: NONE Sue made a motion in the form of a resolution to establish charges for the Fire Charges Ordinance. $150.00/hr pumper; $75.00/hr tanker; $50.00/hr utility vehicle for full runs plus wages and all actual extraordinary costs incurred by the Fire Department. The tables have been purchased; the wall repair completed and Leonard and Ralph will erect the new township signs on October 10, 2003.
NEW BUSINESS: Diane made a motion to have Great Lakes Energy install an overhead light at C-42 and Camp Ten Road. Seconded by Sue and carried unanimously.
Since the Nuisance Ordinance was enacted in 1987 a copy will be sent to Bryan Graham to review it.
Leonard made a motion to accept Huff Excavating bids for snowplowing in 2003 –2004. Plow Truck, $45.00/hr; End Loader, $70.00/hr. Seconded by Diane and carried unanimously. Charges are the same as last year and the township has received a copy of Huff’s workmen’s compensation insurance. Ralph and Leonard will check on the complaints of the condition of the playground equipment.

A regular meeting of the Elmira Township board was held on September 11, 2003 at the Elmira Township hall commencing at 7:05 p.m. with Supervisor, Ralph Robarge calling the meeting to order with the Pledge of Allegiance.
Members in attendance were Supervisor, Ralph Robarge, Clerk, Susan Schaedig, Treasurer, Diane Purgiel, Trustees Leonard Skop and Theresa Plachta. Others attending were Peter Slominski, Will and Rex Savory, assessor Jill Kassuba, Jeff Ratcliff and Jack Thompson.
Jeff Ratcliff of Otsego County Economic Alliance gave a presentation on a county wide growth management process. The board reviewed a resolution on growth management. The board made it clear that they do not wish to participate financially at this time since Elmira is already working with a planner but do support the concept.
Leonard Skop made a motion in the form of a resolution that Elmira Township Board of Trustees agrees to support and participate, subject to final determination of cost, in a county-wide growth management process including the first step which will entail building awareness and developing a comprehensive community vision for Otsego County. Seconded by Theresa and carried.

Will Savory presented an Eagle Scout project for Hallock Cemetery. He would like to locate and unearth all the markers and mark the driveway so that vehicles would not drive over gravesites. The scouts have their own liability insurance and would use their own supplies and equipment.
Theresa made a motion to support the Eagle Scout project in Hallock Cemetery. Seconded by Leonard and carried unanimously.
Ralph met with Adam Cowan, an appraiser hired by Kenwick Corporation, the township’s insurance company to appraise township property.
An M-DOT workshop will be held at the Otsego County Road Commission on 9-18-03 at 1:00 p.m..
Diane made a motion in the form of a resolution to urge Governor Jennifer Granholm to enact Senate Bills 464 and 466 and House Bills 4627, 4630 and 463l which will provide consistent and stable funding to ensure the future of Mackinac Bridge. Seconded by Theresa and carried unanimously.

UNFINISHED BUSINESS Leonard and Ralph met with Tom Deans of the Road Commission to observe the completed Camp Ten Road project. OCRC received a grant to tar and chip Parmater Road at the Eagle Point entrance area due to the lakes and drainage.
Still waiting for a recommendation on fees from the Fire Authority on the Fire Charge Ordinance. Ralph said he will suggest the Authority adopt the Ordinance and approve fees later.
Ralph picked up the signs and flag on 8-21-2003. Ralph and Pat Robarge will grant the township an easement for the placement of the sign on M-32 across from St. Thomas church. Everything is in place to erect the signs. Miss Dig has been notified. Ralph and Leonard will erect the signs.
Leonard will purchase the tables from Sams Club and be reimbursed by the township since there is no benefit to obtaining a membership for Elmira Township.
The hall wall repair will be completed the week of September 15th.
No information on the Lamar issue at this time.

Diane read the PC’s August minutes. Diane made a motion to approve a $25.00 purchase by Suzanne Bannister for “The Planning Commission Toolkit”. Seconded Theresa and carried unanimously.
Diane suggested that board members take turns being on the Planning Commission for one year or have a zoning board.
Diane read a letter from Northwestern Bank in regard to the financial services they have to offer. The board discussed a rumor about the feds being called in to investigate First National Bank on their banking practices. The board directed Diane to check into the situation and take funds out of First National if necessary since she has always made sound decisions in the past. Diane stated that we have always had good service from First National and they are a local bank we could keep up to 100,000.00 there since it is insured and invest the rest at Northwestern.
ASSESSOR’S REPORT: Bill Kerr requests Jill attend a training on the mapping program on September 25th from 8:00 until 12:00 at the MTEC building. Seeking township approval.
Patricia Osborne requests that Elmira review the Elmira Plat and get back with her.
Skibinski case was submitted by Mr. Skibinski to the Tax Tribunal and Jill spoke with them to say that it is being handled at the State Tax Commission level and she is waiting for Mr. Schnelle to respond to the numbers and figures she presented to him in July.
Wolverine Power Supply Cooperative Inc has motion ed to add the 2003 Tax year to their Case. Michael A. Stimpson will be the presiding Tribunal Judge.
Jill received a quote of $1,395.00 for a computer from Cliff. Since Cliff has been slow on responding in regard to repairs the board directed Jill to check with Jim Theisen for a quote.
Theresa made a motion to allow Jill to purchase a computer system through Jim Theisen up to $1,500.00. Seconded by Diane and carried unanimously.
Diane made a motion to allow Jill and any Planning Commission member to attend the mapping program with wages paid. Seconded by Leonard and carried unanimously.
Ralph received several estimates on LP gas for the 2003-2004 season. Gaylord Gas offered 107.9 for the season. No one else would give a cap. Elmira Township will continue to purchase LP from Gaylord Gas.
Ralph suggested that the septic system at the township hall should be checked and pumped. Ralph will locate and dig up the area for $25.00.

A regular meeting of the Elmira Township board was held on August 14, 2003 at the Elmira Township hall commencing at 7:00 p.m. with Supervisor, Ralph Robarge calling the meeting to order with the Pledge of Allegiance.
Board members present were Supervisor, Ralph Robarge, Trustees, Theresa Plachta and Leonard Skop. Clerk, Susan Schaedig and Treasurer, Diane Purgiel were absent. Deputy Clerk, Sara Schaedig, Ron Geiger, Robert & Jean Brown, Tim McPhearson and sons, Zander and Miles were also present.
Leonard made a motion to accept the minutes as presented. Seconded by Ralph. Theresa did not vote since she had not attended the July meeting.
PUBLIC COMMENT: Bob Brown questioned why the repeal of the garbage ordinance was not in the paper. Note : the July synopsis of the Elmira Township minutes and the Ordinance to Repeal the Garbage Ordinance were both in the Gaylord Herald Times.

ORDINANCE OFFICER REPORT: Ron reported that things are going well with the foreclosed property and he is still working on the junk cars complaint.

Still waiting for a recommendation from the Fire Authority on fees for the Fire Charge Ordinance. Tabled.
Ralph reported that the Township signs and flag are completed and received a permit from M-Dot.
Leonard reported that he has not yet purchased the tables for the hall.
Board members Ralph and Diane, and attorneys, Bryan Graham and John Mulvihill met with Attorney, Tom Cecil of Lamar Signs on August 11, 2003. Ralph, Diane and Bryan gave depositions to Mr. Cecil in regard to the Lamar Advertising lawsuit.
NEW BUSINESS:
Jeff Ratcliffe of the Otsego County Economic Alliance will give a presentation on September 11, 2003 on the county wide growth management process to Elmira Township. He has a resolution for the township to sign supporting the process.
The next Township Association meeting will be held on September 21, 2003 at Chester Township at 7:00 p.m..
Tim McPhearson asked the board if they would be interested in having the Boy Scouts find all the metal markers in Hallock Cemetery. He stated that they need projects. Vicky Savory is the contact person.

ELMIRA TOWNSHIP MEETING MINUTES COUNTY OF OTSEGO ELMIRA, MICHIGAN July 10, 2003 A regular meeting of the Elmira Township board was held on July 10, 2003 at the Elmira Township hall commencing at 7:00 p.m. with Supervisor, Ralph Robarge calling the meeting to order with the Pledge of Allegiance. He states that Elmira Township is in violation of the Headlee Amendment and will bring criminal charges against the supervisor and the board if the issue is not resolved in 45 days. Tammy Phillips, a trustee on the Otsego County Library Board and Maureen Derenzy, Library Director gave a presentation on the Library millage election to be held on August 5, 2003. UNFINISHED BUSINESS: Tom Deans of the OCRC thought that the paving may start on Camp Ten in a couple of weeks. The township signs and flag have been ordered and Ralph is working on the permits from M-Dot. The board will go into closed session at the end of the meeting in regard to the Lamar issue. NEW BUSINESS: Sue has requested a metal detector to use in Hallock Cemetery. The metal posts are buried and are difficult to locate. Sue made a motion to purchase a metal detector from Coins & Collectibles for 145.00. Seconded by Diane and carried. Diane is working on a newsletter and work like board input on info. The Economic Alliance has scheduled a meeting on 7-21-2003; 5:00 p.m. at the University Center, Room U-109. Keith charters will facilitate this meeting. Sue made a motion to appoint Peggy Hall, Barb Fleming, Doreen Ostrander and Sara Schaedig as election inspectors for the Special Election to be held on August 5, 2003. Seconded by Diane and carried. Lost Valley Camp has requested a fireworks permit. Ralph is receiving information from MTA in regard to this issue. No action taken at this time. Sue made motion to allow any board member to attend the workshop on Township Law 101 at Treetops on August 25, 2003. Wages and registration to be paid by the township. Warner Township received three bids for Maple Hill Cemetery for digging out stumps, some trees, graveling road with 200 yards with 22A, filling in the stump holes and leveling the ground with the contour of its shape. L & G Excavating is about half the amount of the other two bids. The board had no objection to this bid from L & G and will pay half of the $4,800.00. Leonard will purchase the tables from Sams. He will check on acquiring a credit card from Sams in the Township’s name or the possibility of using the Wal Mart card the township currently has.
NEW BUSINESS: The National Association of Towns and Townships will hold the 2003 Legislative and Educational Conference in Washington D.C. in September. Leonard made a motion to allow any board member to attend with room and registration fees(149.00) to be paid by the Township. Seconded by Theresa and carried.
There will be an Otsego County Economic Alliance meeting held on 6-24-03. This is the same night the Elmira PC has a meeting planned. Sue will contact Duane Hoffman to see if he would mind changing the PC meeting date so that ET board members may attend both meetings.

A regular meeting of the Elmira Township board was held on May 8, 2003 at the Elmira Township hall commencing at 7:00 p.m. with Supervisor, Ralph Robarge calling the meeting to order with the Pledge of Allegiance.
Members present were Supervisor, Ralph Robarge, Clerk, Susan Schaedig, Treasurer, Diane Purgiel, Trustee, Leonard Skop and Trustee, Theresa Plachta. Assessor, Jill Kassuba and Tom Deans of the Otsego County Road Commission were also present.
Tom Deans presented three bids for paving Camp Ten Road. Payne & Dolan, Inc. bid is $151, 247.00, Rieth-Riley Construction Co., Inc. bid $131,400.00 and H & D Inc bid $127,304.50. The original estimate of the project is $113,500 with township share of $55,750. Tom recommended the H & D bid of $127,304.50 with a 50% share cost of $63,652.25. A difference of $7,000 from the original bid. Leonard made a motion to accept H & D Inc. bid of $127,304.50 with the 50% share cost of $63,652.25 for furnishing and placing hot mix asphalt paving on South Camp Ten Road. Seconded by Diane and carried unanimously. The board discussed the conditions of Mt Jack Road and North Camp Ten Road with Mr. Deans.

PLANNING COMMISSION REPORT: The PC has requested the township to send a letter to Bill Kerr requesting to allow Mary Campbell of M.C. Planning & Design and Duane Hoffman, Township PC Chair use of the maps & aerial system that is available to Elmira Township. This permission does not allow them to create any new layers or added expense without prior approval from Elmira Township.
Sue made a motion to pay fees and wages for Suzzane Bannister and Gloria Torello to attend the Water Quality program on June 25, 2003. Seconded by Leonard and carried unanimously. Theresa made a motion to pay fees of $210.00 and wages for John Ernst or any township board or planning commission member to attend the Citizen Planner meetings. Seconded by Leonard and carried unanimously.
ASSESSOR’S REPORT: Maintaining Assessment Roll. Entering warranty deeds and transfers as they come in. Updating the homestead list to verify with County Equalization. Having trouble backing up the 2003 assessment BOR roll through the BSA program. No land divisions. Working on the Skibinski property with the State Tax Commission. Reached a mutual agreement with a taxpayer on correcting an error. Will be handled at the July BOR. Jill is trying to figure out who owns the gas/oil compression buildings and cell towers throughout Elmira Township. Any corrections on these 068-898 parcels will be handled at the July Board of Review. This was a new law that came quickly requiring immediate roll placement, therefore some buildings may have been double assessed on real and personal property(this is where the business reported them prior to the 2003 assessment roll). Attempting to verify where they reported their buildings. Jill signed the Assessor Contract on April 21, 2003.
UNFINISHED BUSINESS: Ralph and Leonard met with Mr. Graham to discuss amendments to the Fire Charge Ordinance. A draft will be ready for the June 12, 2003 meeting. Mr. Graham will draw up a rescission ordinance for the Trash Pick-Up Ordinance when the board is ready.
Diane made a motion to purchase a township flag for 791.00 from Black Forest. Seconded by Theresa and carried. Leonard made a motion to purchase two one sided signs at $1,400 each from Black Forest. Seconded by Diane and carried. These signs will be placed at entry points into Elmira Township.
Theresa made a motion to purchase plastic top tables from Sams at 69.44 each(30” x 96”). Seconded by Leonard and carried.
CenturyTel is applying to the township for a permit for transmission lines under the Metro Act. There are two different permits which have been approved by the MPSC. A bilateral permit which has a term of up to 30 years and a unilateral permit which the term is for 5 years or less. Mr. Elsenheimer recommends approving and signing the bilateral permit. Leonard made a motion to approve a bilateral agreement with CenturyTel. Seconded by Theresa and carried.
NEW BUSINESS: The play structure in the park has some loose nails. Ralph will have the insurance company check it out for safety reasons.
The Township Association Chapter meeting will be held on May 20, 2003 at Chester Township.
Diane made a motion to reappoint Duane Hoffman to the Elmira Township Planning Commission. Seconded by Leonard and carried.

The board needs to inquire into this issue. ASSESSOR’S REPORT: Jill reported that she is maintaining the roll and updated the board on the Norbert Skibinski Tax Tribunal case. She discussed her contract with the board. UNFINISHED BUSINESS: Theresa is looking for information or suggestions for the Township web site. The Planning Commission meeting will be held on Tuesday, April 22, 2003 at 7:00 p.m. at Elmira Township hall. Everyone is invited to attend. Ralph checked with Mr. Kerr to confirm the cost at $1.00 per parcel for the Mapping and Aerial System for Elmira Township approved by the board in March. Sue read a letter from the Metro Authority stating that they had received a copy of the resolution and ordinance of the Metro Act. This notification makes the township eligible to receive fees to be distributed to municipalities. The Trash Pick-Up Ordinance was discussed. Theresa suggested that the board wait until the July meeting and if there is no further interest it is the board’s intention to rescind the Ordinance at that time. Leonard and Ralph will meet with the attorney and obtain the proper procedure in writing for the rescinding of the Ordinance. Board members are continuing to search for tables to purchase for the hall. NEW BUSINESS: Jill requested a five to ten percent increase in her salary for the 2003-2004 assessor’s contract. Leonard made a motion to offer Jill a three percent increase. Discussion followed. Since the township will be collecting summer taxes there will be an increase in work for the assessor including the July Board of Revue. Diane made a motion to increase the assessor’s salary five percent for the 2003-2004 contract. Seconded by Theresa and carried. Ralph and Leonard voted no on the issue. David Carson was notified by the State that water sampling, reports etc have to be done an on annual basis. Therefore he has offered to lower the yearly fee from $250.00 to $100.00. Leonard made a motion to accept David Carson’s water sampling contract at $l00.00 for the yearly fee and additional work fees to remain at $40.00 per visit or $25.00/hr for an extended visit. Seconded by Theresa and carried unanimously. Attorney Brian Graham reviewed the Fire Charge Ordinance and recommended it be amended to include structures. There was board discussion. Ralph and Leonard will meet with Brian and have him prepare a draft. The Fire Authority will have the responsibility of collecting the fees generated by the Ordinance. Ralph received information from Black Forest Co. in regards to a flag and sign. The township flag would cost about $791.00. No decision made. The board discussed the possibility of an overseer at the hall during parties. Sue made a motion to pay registration fees and wages for any board member to attend the Spring District Meeting(Treetops-May 15) Other People’s Money(Treetops-June 5) or Telecomm on April 25 at M-Tec. Seconded by Diane and carried unanimously. Diane and Sue informed the board of the complaints about the playground equipment coming apart. The board gave Diane permission to have a distinctive ring on her telephone and the cost to be paid by the township. A regular meeting of the Elmira Township board was held on March 13, 2003 at the Elmira Township hall commencing at 7:00 p.m. with Supervisor, Ralph Robarge calling the meeting to order with the Pledge of Allegiance.
Members attending were Supervisor, Ralph Robarge, Clerk, Susan Schaedig, Treasurer, Diane Purgiel, Trustees Leonard Skop and Theresa Plachta. Assessor, Jill Kassuba, Ordinance Officer, Ron Geiger, Commissioner, Al Bentz and several residents were also in attendance.
PUBLIC COMMENT: Residents commented on road conditions of North Townline and North Camp Ten. Al Bentz gave a brief report.
The minutes were accepted as corrected.

ASSESSOR’S REPORT: Assessment Roll is complete and balanced thus far with Equalization. March BOR will reconvene on 3-17-03 for closing signatures. Total Protesters were 25 residential and 12 personal property. Final ratios: Ag 49.92; Res 49.17 and Comm 49.18. Parcel Count 1494. Ending taxable value estimated at 55,305,939. Over 1452 assessment change notices were mailed.
No Land Divisions.
ORDINANCE OFFICER REPORT: Ron reported that he is continuing to resolve two complaints.
UNFINISHED BUSINESS: Ralph and Leonard met with Mr. Graham and reviewed in depth the options to consider about the curbside garbage pick up. After much discussion, they hereby recommend that the township board not pursue.
Diane suggested that the board rescind the Trash Pick Up Ordinance. The board decided to table this issue for a while to see if there is any interest of any resident in pursuing this matter.
Diane made a motion not to pursue the curbside trash pick up but leave it to those who are in favor to petition the township if they so choose. They would have to collect over 50% of signatures of the affected property owners before continuing on. Seconded by Theresa and carried.
Leonard made a motion to adopt the Metro Act Resolution. Seconded by Diane and carried. AYES: Ralph, Susan, Diane, Leonard, Theresa NAYES: None
NEW BUSINESS: Diane read a letter from William Kerr, Equalization Director who is proposing a mapping and aerial project that will include all townships. The board discussed the proposal. Diane made a motion to participate in the 2003 Mapping and Aerials Project for Elmira Township at a $1.00 per parcel. Seconded by Leonard and carried. Ralph will contact Bill to obtain a firm figure on this project.
The Township Association meeting will be held on March 18, 2003 at the Elmira Township hall at 7:00 p.m.. There will be a presentation by the MSU Victor Land Use Institute and MSU Extension on an opportunity to undertake a comprehensive community-wide planning effort.

Diane read a letter from Jon Jenkins informing the board of his personal concern in regard to the trash removal service. It is his desire that this service not be forced upon property owners and he will not use it.

NEW BUSINESS: The Road Commission will hold their annual meeting with the township on March 06, 2003 at 10:00 a.m. Township attorney, Kevin Elsenheimer highly recommends adoption of a resolution of implementation of the Metropolitan Extension Telecommunications Rights-of-Way Oversight Act(Metro Act). This Act is intended to bring additional funds to townships for allowing public rights-of-way to be used by telecommunications providers. Issue was tabled. Ralph will speak with Kevin to ask about distribution and a copy of the act.
Theresa explained the Gypsy Moth Program and the spray areas in Elmira Township.
The board discussed the possible Elmira-Warner School closing. It is not an issue for the Elmira Township board and therefore no action was taken.
A letter from NEMCOG stated that they are currently in the process of gathering information and developing community profiles to adopt a Hazard Mitigation Plan. Township representatives are highly encouraged to attend meetings with the Local Emergency Planning Committees (LEPC) and to fill out the questionnaire to aid in the planning.

Jason of Arrow Sanitation stated that his company was interested in servicing Elmira Township for curbside pickup. He will put together different plans and pricing for the board to consider.
The curb side trash pickup issue will be discussed at a later meeting.

Diane stated that Bill Kerr has increased the base cost of service from .75 to a 1.00. The treasurer will continue to send receipts with the tax bills.
PLANNING COMMISSION: Leonard made a motion to allow the PC to engage the services of MC Planning & Design to prepare the Elmira Township Master Plan at a cost not to exceed $9,250. Seconded by Theresa and carried unanimously.
Diane made a motion to allow the PC to handle the Billboard ordinance. Seconded by Theresa and carried unanimously.
ASSESSOR’S REPORT: Jill is still reviewing study information compiled by the Equalization Dept. Our current ratio of Residential is 47.23, Commercial is 45.08 and Agricultural is 42.27.
December BOR is closed. There were 28 total corrections. There were 80 personal property statements sent out.
Land Divisions: Franckowiak 060-030-300-030-07 approved Godlewski 060-034-200-005-00 approved ORDINANCE REPORT: Ron received a complaint in December on unlicensed vehicles. He is awaiting approval of a mortgage on the foreclosed complaint.
NEW BUSINESS: Diane wishes to resign from the Planning Commission. A township board member has to be appointed. No action taken at this time.
The Township Association meeting will be held on January 21, 2003 at Corwith Township hall at 7:00 p.m.. A county forum will follow the regular meeting. Elmira will host the March 18th meeting.
John Ernst’s appointment to the Otsego County Planning Commission expires on March 10, 2003. Action was tabled.
Sue made a motion to allow $100.00 for meals, per diem and mileage for the MTA convention. Seconded by Theresa and carried unanimously.
